1. Acceptance of Terms
By accessing or using ClarUP ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 16 years of age, or the age of majority in your jurisdiction, whichever is greater.
2. Description of Service
ClarUP is an AI-powered career intelligence platform that provides:
- Psychometric Assessments: Personality, interests, and values assessments to understand your career fit.
- Career Matching: AI-driven recommendations based on your assessment results and market data.
- Career DNA Reports: Comprehensive analysis of your strengths, preferences, and ideal career paths.
- Learning Paths: Curated skill development recommendations and course suggestions.
- Day-in-the-Life Simulations: Interactive experiences to explore careers before committing.
Important: While our insights are data-driven and personalized, you remain responsible for your own career decisions. We recommend consulting with professional career counselors for major life decisions.
3. User Accounts
When you create an account with us, you must:
- Provide accurate, complete, and current information during registration
- Maintain the security of your password and accept all risks of unauthorized access
- Immediately notify us of any breach of security or unauthorized use
- Not create accounts using automated means or under false pretenses
You are responsible for all activities that occur under your account. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.
4. Payments, Refunds, and Billing
Pricing
Prices for Pro subscriptions and services are listed on our pricing page and are subject to change. We will provide at least 30 days' advance notice of any price changes for existing subscribers.
Payment Processing
All payments are processed securely via Razorpay. We accept major credit cards, debit cards, UPI, and Netbanking. We do not store your full payment card details on our servers.
Refund Policy
Pro subscriptions are eligible for a 7-day money-back guarantee from the date of purchase. After 7 days, refunds are handled on a case-by-case basis. See our Refund Policy for full details and eligibility criteria.
5. Subscriptions
Auto-Renewal
Subscriptions automatically renew at the end of each billing cycle (monthly or yearly) unless cancelled at least 24 hours before the renewal date. You will be charged using the same payment method on file.
Cancellation
You may cancel your subscription anytime from your account settings. Cancellation stops future billing but does not provide partial refunds for unused time. Your Pro access continues until the end of your current billing period.
Free Trial
If offered a free trial, you will not be charged until the trial period ends. You can cancel at any time during the trial with no charge.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any laws
- Attempt to gain unauthorized access to the Service or its related systems
- Interfere with or disrupt the Service or servers connected to it
- Share your account credentials with others
- Use automated systems, bots, or scrapers to access the Service
- Reproduce, duplicate, copy, sell, or resell any portion of the Service
- Manipulate assessment responses to obtain false results
- Use the Service to harm, threaten, or harass any person
7. Intellectual Property
The Service and its original content (excluding user-provided data), features, and functionality are and will remain the exclusive property of ClarUP and its licensors. This includes:
- All assessment methodologies and algorithms
- Career matching systems and scoring mechanisms
- Report templates and visualization formats
- User interface designs and branding elements
- Educational content and course materials
You retain ownership of any personal data you provide. By using the Service, you grant us a license to use this data to provide and improve our services, as outlined in our Privacy Policy.
8. Data Protection & Privacy
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. Key points include:
- Data Export: You can export all your data at any time from your account settings
- Account Deletion: You can request account deletion with a 30-day grace period to cancel
- Cookie Control: You can manage cookie preferences through our consent banner
- GDPR Compliance: We comply with GDPR and respect your data rights
9. Limitation of Liability
In no event shall ClarUP, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:
- Loss of profits, data, use, goodwill, or other intangible losses
- Career decisions made based on our recommendations
- Service interruptions or unavailability
- Unauthorized access to or alteration of your data
Our total liability for any claims arising from your use of the Service is limited to the amount you paid us in the 12 months preceding the claim.
10. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including but not limited to:
- Breach of these Terms
- Fraudulent or illegal activity
- Extended periods of inactivity
- Request by law enforcement
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or use the deletion option in your settings.
11. Changes to Terms
We reserve the right to modify or replace these Terms at any time. For material changes, we will provide at least 30 days' notice before the new terms take effect.
Your continued use of the Service after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically for any changes.
